They should have been able to inference it from the fact that virtually everyone in East Prussia was fleeing the Soviet advance but yeah, that's why the sinking is classified as a "legitimate" act of war rather than a heinous crime and was allowed to be swept under the rug. Unlike most /pol/tard accounts of Allied atrocities, this one actually was the subject of an extensive coverup

Just because people were fleeing East Prussia doesn't mean this particular ship with no markings and military weapony aboard was not filled with the remnants of a Wehrmacht division as opposed to civilians. They had to make a decision, and they made it.

lmao I actually came up with a subplot of the pregnant Anne Frank timeline where the Confederate Navy sends a detachment of UDTs (Underwater Demolition Team) to seize the Cap Arcona, thinking that they'll capture the SS leadership, in an attempt to one-up the British.

[spoiler]It turns into a total shitshow that results in the rescue of the prisoners, Confederate fighter jets and British Typhoons dueling it out in the skies, the city of Lübeck being burned to the ground and thousands of German civilians being killed in the process.

Disaster researcher Heinz Schön concludes that the liner was a military target and its sinking was not a war crime, as:
ships intended for the transport of refugees, hospital ships had to be marked with the appropriate signs - a red cross, could not wear camouflage colors, could not go in the same convoy with military ships. "Wilhelm Gustloff" was a warship, being assigned to the naval forces and armed, which was allowed to climb six thousand refugees. "Wilhelm Gustloff" accompanied by a German naval battleship (the Lev destroyer);
Soviet transports with refugees and wounded during the war years repeatedly became targets for German submarines and aviation (in particular, motor ship "Armenia", sunk in 1941 in the Black Sea, carried more than 5 thousand refugees and wounded on board. Only 8 people survived. However, "Armenia", like "Wilhelm Gustloff", violated the status of a medical vessel and was a legitimate military target).

There is no way the Soviets could know they were civilians. Wilhelm Gustloff was armed and dangerous. Nothing indicated that it was a hospital ship evacuating refugees. To any outsider, it was another German warship.

Especially the freezing waters of the Mid-January Baltic sea. Most victims of the Titanic didn't drown, they froze to death, and it took minutes. Water is always colder than you think.
